The Terms and Conditions (“Terms”) are set forth by Dialect, LLC, a North Carolina Limited Liability Corporation, P.O. Box 560665, Charlotte, NC 28256 (“Dialect”) and the purchaser who is an entity or a person who has purchased any of the products offered on this Dialect’s web-site “http://www.dialectdesign.com/” (“Purchaser”) agrees to this document of “Terms and Conditions”, any attached General Provisions and any specifically referenced attachments. This document will interchangeably refer to “Dialect” as “Dialect Design” or “Us” or “We” and will interchangeably refer to the “Purchaser” as “You” or “Client” herein.
Building Codes and Regulations:
All sets of house plans may need to be modified to comply with local regulations, building codes, zoning ordinances, and local laws where the building is to be constructed. Since all states, municipalities, and counties in the United States have their own specific requirements, building codes, zoning ordinances and local laws, You may need to obtain building permits from your local government agencies, including but not limited to, building-code-enforcement agencies and zoning agencies before and during construction. Some states, cities and local laws also require You to have a licensed architect or a structural engineer review and "Seal" the plans prior to construction.
Foundation Plans:
The foundation plans in each set of house plans sold on Our website “http://www.dialectdesign.com/” have been developed without the knowledge of a specific site or geographical area, therefore foundation plans may need to be modified to correspond to Your specific building site, soil, climate, natural conditions and Your local building codes and regulations. You should have the foundation plans reviewed and sealed by a structural engineer or an architect before the start of construction.
Return Policy:
All sales made on Our web site “http://www.dialectdesign.com/” are final, therefore there are no refunds or exchanges. All plans sold on Our web site are offered as is. Dialect Design disclaims all other warranties, express or implied, including but not limited to merchantability or fitness of purpose.
Copy Restrictions, Use of Designer’s Drawings, Intellectual Property:
All home plans We offer on Our website “http://www.dialectdesign.com/” may not be used for the construction of more than one residence. All of Our plans offered on Our website are protected under U.S. copyright laws. Dialect Design retains all rights, title, and ownership of the original design and all documentation including but not limited to the modified design, plans, which are considered to be “derivatives” of the original, and all supporting documentations. Dialect will also retain all common law, statutory, and other reserved rights, including the copyright and intellectual property rights.
Please note that the copyright infringement fine is currently $250,000 per incidence, plus all attorney fees.
The Purchaser and all other parties that have gained knowledge to the specifics of these plans through involvement formally or informally through the Purchaser including but not limited to companies, organizations and persons, will not be permitted to use any of the ideas, designs, or drawings, including but not limited to ideas and designs for any purpose, including but not limited to the development of construction drawings, advertisement, and construction except through the written consent by Dialect. Purchaser will not be permitted to use any ideas, designs, or drawings for construction, unless the Purchaser receives from Dialect a set of drawings. Drawings prepared by Dialect are instruments of service for use solely with respect to the one time use for one instance and for one unit of this project.

All of the plans and designs offered by Dialect, LLC on this website “http://www.dialectdesign.com/” are exclusively created by their staff and contractors. Due to the many variables beyond our control, such as site conditions, variations in the construction materials, and the builders’ work, neither Dialect, LLC, nor their owners, employees, and subcontractors are or can be responsible for any use that is made of these plans.
All of Our plans have been prepared as a general residential design and have been developed without the knowledge of a specific site or geographical area, therefore supplemental to these plans and documents, it is the Purchaser’s builder’s and the Purchaser’s responsibility to adhere and follow all the equipments and the material’s manufactures guide lines and instructions. in addition, the Purchaser and the Purchaser’s builders are liable to practice the accepted standards for each building trade and material. All topographic, climatic conditions and local building codes should be verified and all foundation plans adapted accordingly.
Before the start of construction, the builder should check, verify, and be responsible for all dimensions and other details, by reviewing the plans for compliance with the governing local and state building codes and regulations for the geographic area in which the house is to be built. All local and state building codes and regulations must govern over all the plans sold on this Dialect’s web site “http://www.dialectdesign.com/”. All dimensions written on the plans govern over the scale of the plans in which it has been printed.
The Purchaser should check with the local building code enforcement and the zoning offices to verify and meet all requirements to adapt the plans for construction purposes. Any use of these plans without adaptation to the local and state standards, codes, site conditions and all other factors is at the Purchaser’s sole risk. Dialect, LLC assumes no responsibility for changes made to these plans by others and makes no warranties, either expressed or implied, regarding these plans. The Purchaser agrees to indemnify, hold harmless, and defend Dialect, LLC, and their designers, employees, and subcontractors for all claims, costs, losses or damages resulting from the use of this information.
We only authorize the use of Our plans on the express condition that the purchaser comply with all local building codes, regulations, zoning requirements, and other applicable local and state laws, and ordinances.
Permission to Use Photographs:
Dialect will retain unlimited permission and right to photograph any construction and completed building in conjunction with the drawings furnished by Dialect. Dialect shall be the owner of all photographs of any construction and completed building in conjunction with the drawings furnished by Dialect (“Photographs”) and shall have the unrestricted right to take and use such Photographs in its sole discretion. Use of the Photographs by Dialect may include, but not be limited to, business brochures, marketing materials, website or other promotional items. Dialect may use and publish the Photographs in paper, media, or digital form. Any person or entity involved with any construction and completed building in conjunction with the drawings furnished by Dialect hereby unequivocally and completely waives any copyright or proprietary rights which it may have in the Photographs. Any Fees or remuneration, which Dialect receives, which is in any way connected to the Photographs shall belong solely to Dialect and no other person or entity shall have any rights thereto.

3/13/09: Working On The Next Modern House Plans!
We are currently working on a new concept house to add to our collection of modern house plans. In part due to the economic downturn, but also out of environmental concerns, home owners are slimming down on the size of their homes.
The excess in house construction had also been an excess in constantly increasing square footage. We hear now from our customers and the press that there is an interest in smaller, more efficient and compact home plans. Our modern design approach allows, of course, for us to be playful and innovative about the size of a house. It is not a question of giving up certain amenities or luxuries. It is a question of how to meet these expectations.
We have found that most home plans that are geared to meet a more, so called, traditional market are bound by a set of formulas that are rather restrictive.
The European style modernity and innovative exploration found in current American and Australian architecture gives us the freedom to design towards our customers’ specific needs and ideas. In the selection of our modern house plans we try to cut down on square footage, building cost and the future fees of energy bills, while being expensive in the quality of the spaces, the engagement in your daily life, and contemporary patterns of living. The current set of modern house plans we are developing is meeting all these concerns even more stringently.
One of the big questions we are tackling is how to meet a variety of contemporary living arrangements with a smaller house. That means can we offer modern house that meets a two person couple, a single parent with two kids, a small family with a live-in grandparent, as single professional subleasing a full unit, stay at home professional parents with a set of kids, and all the other current ways of living together? Yet, the proposed house plans would have to be cost effective to construct and end with a low energy house. And in addition it has to be cool and sexy to meet the current desires and whishes of living.
We’ll keep you updated as we move forward. When it’s all worked out we will add it to our selection of modern house plans.

4/30/09: Original Designs!
We spent some time with renowned writer, actor, force-of-live, performer John W. Love Jr. in our studio. He took us deep into the world of theater, including the dynamics between playwright, producer, director, and actors.
Part of our discussion hovered around the origin of a specific piece of creative art; may it be a play or a beautiful well designed modern building. The parallel, of course became fascinating, as any modern house would have a designer, a builder and a developer and/or home owner. In either case, play or architecture, all parties are involved bringing richness to the work at hand. They shape and are integral in the final full experience to be had.
With the play, however, we named the play write the originator of the piece. The playwright conceives of a lived experience, to which all other participants bring their talent and skills. They bring it to life on a stage. There is an intent and an original thought, vision, questioning and creation that are all asked to be understood and developed to its full intended being.
Well, this morning we saw an article in the Charlotte Observer about the present state of architects in this city, emblematic we are sure, for the entire nation. The unfortunate aftertaste, reading the article, was that of a dis-connect of the architect from the art of their craft. The short pieces of interviews read as sad reactionary attitudes towards the direction given by the Developers or the Investors; the architect rendered voiceless as the mere technician, the executer of only monetary interests. The playwright, we are sure, often writes a play, without maybe a specific venue or production in mind. Even though the reverse happens, too.
The architect, of course, is being called in when somebody with the finances says “go” first. But what then? Does that make the faceless number-driven developer the originator? Or is it still the artist, the playwright, the designer? And we mean the art of a building, the true lived experience, the life it breathes.
There are creative developer-designer-builder teams or entities out there that might be all in one. And we enjoy working with creative minds and give great credit and much thanks to all of our friends who have brought challenging propositions to us. Once we get going, though, we tend to create a piece of art that wasn’t there before. We induce our own seedling into the process that grows into its own artistic experience, into a building that will give you goose bumps when you will finally enter it in person (good goose bumps, of course ;) ). In that sense we think of ourselves as the ones that create as artist the lived experience of a modern house. It is not that we don’t execute our clients’ wishes or needs and we also do not disregard economic parameters. But we take all the pieces, hundreds of them, and shape them into a true piece of art.
We live through a creative process that dreams up, develops, and truly lives the experiences to be had in a specific built environment, a specific contemporary home. When we got to build it ourselves, we got to direct and act a little. And when we developed ourselves, we got to produce a little. But, we think of ourselves as play writes maybe first and foremost. It occurred to us that offering our modern house plans online, makes us then truly the play write. The original design lies in our fingertips. We create these modern house plans as creative expressions as a result of our artistic needs.
The clarity in this realization meant for us that you are sure going to see designs coming up that are much more free in nature; designs born out of our expressive need maybe, more so than pragmatic needs. They will be buildable and they will be beautiful, and they might be for just the few of you, who want just that one special, crazy, cool modern house design that will make you live a life you always wanted and could never dream of.
